Legal expenses insurance (Rechtsschutzversicherung) can cover court and lawyer's fees in the areas of life you choose. As a rule, the dispute must not already have started or been foreseeable; important exclusions remain.

In short: Legal expenses insurance pays lawyer's fees, court costs and expert fees in the areas of life you insure – such as work, traffic or housing. It is worth it above all for employees, tenants and frequent drivers. Cover only applies to disputes that arise after the policy starts and usually only after a waiting period.

The four modules at a glance

ModuleTypical cases
PrivateDisputes with retailers, tradespeople or tour operators, compensation claims after an accident
WorkDismissal, formal warning, disputes about pay, references or overtime
TrafficAccident claims, fines, disputes when buying a car or with a garage
HousingRent increases, service charge statements, notice from the landlord, disputes with neighbours

You can usually choose the modules individually or combined. Combinations are often cheaper than several separate policies.

Which costs are covered

  • Your lawyer's fees under the German Lawyers' Remuneration Act (RVG)
  • Court costs and the costs of witnesses and experts
  • The other side's lawyer's fees if you lose
  • Depending on the policy, mediation, an initial legal consultation by phone and criminal bail

In principle, you are free to choose your lawyer (section 127 VVG). Some policies offer a discount if you use a lawyer recommended by the insurer or try mediation first.

Cost example: an unfair dismissal claim

Employment law in Germany has a special feature: at first instance before the labour court, each party pays its own lawyer's fees – even if it wins (section 12a ArbGG). If you challenge your dismissal, you will pay your lawyer yourself either way. Because the amount in dispute is based on several months' gross salary, the costs quickly reach four figures. This is exactly where legal expenses cover for work is particularly valuable.

Waiting period and pre-existing disputes

Most modules have a waiting period after the policy starts, often three months. For compensation claims after an accident and for traffic legal cover there is usually none. In addition, the cause of the dispute must arise after the policy starts: if you only take out cover after being dismissed, that particular case is not insured. An ongoing conflict cannot be insured retrospectively.

Who legal expenses insurance is worth it for

  • Employees, because of their own lawyer's fees in employment law – unless a trade union already provides legal protection.
  • Tenants, for disputes about rent and service charges – a tenants' association (Mieterverein) can be a cheaper alternative.
  • Frequent drivers, for accident claims and fine proceedings.

Legal expenses insurance makes less sense if you rarely get into disputes and could pay a possible lawyer's bill from your own savings. Frequently asked questions

What does legal expenses insurance cover?

Legal expenses insurance (Rechtsschutz) pays the costs of a legal dispute to the agreed extent, such as lawyers' fees, court costs and expert fees, as well as the other side's costs if you lose. Only the modules you have chosen are covered, for example private life, work, traffic or housing. Whether a specific case is insured is decided by the confirmation of cover (Deckungszusage), based on the terms.

What does the waiting period in legal expenses insurance mean?

Many modules have a waiting period of a few months during which there is no cover yet for new disputes. In addition, the dispute usually must not have arisen before the contract started. Conflicts that are already under way or foreseeable can therefore usually not be insured.

Which cases are typically excluded?

Common exclusions include disputes about investments, building work on your own property, family law disputes beyond an initial consultation, and intentionally committed criminal offences. The exact list differs from policy to policy. Read the list of exclusions before you decide.

Is legal expenses insurance worth it?

For many employees, tenants and drivers, yes, because a single dispute can cost several thousand euros – and in employment law you pay your own lawyer at first instance even if you win. If you are a member of a trade union or tenants' association, some of the risks are often already covered.

Can I take out legal expenses insurance for an ongoing dispute?

No. Only disputes whose cause arises after the policy starts and after the waiting period has expired are covered. A dispute that has already begun or was foreseeable remains excluded.

Can I choose my own lawyer?

Yes, the right to choose your lawyer freely is set out in law (section 127 VVG). Some insurers offer a lower premium or waive the excess if you use a recommended lawyer – but they cannot oblige you to do so.
